Job Location :Head Office

Job Purpose:

Assisting the Senior Manager; Civil Litigation in managing the Civil Litigation unit in day-to-day duties pertaining to management of bank’s litigation, control of risks associated with litigation and advising branches as well as head office departments on litigation matters.

Main Responsibilities:

Strategic Focus

Assign cases to external legal counsels and update Litigation Report/ Legal system.
Attend courts/tribunals and other forums to represent the bank in insourced litigation.
Review and/or draft pleadings.
Support external legal counsels in obtaining witnesses and documents.
Arrange and participate in case preparation meetings.
Oversee Primary court (PC) cases from initial stage to finalization and update PC cases tracker.
Follow up on and receive external counsel’s reports and update litigation report/ Legal system.
Confirm external counsel’s invoices for payment and record all payments (fees and reimbursable costs)
Preparation of memos for payment in out of court settlement arrangements and following up on execution of the same
Prepare monthly lists of completed cases and follow up on recovery of legal fee from completed cases.
Assist the Senior Manager; Civil Litigation in assessing External Counsel’s performance on a quarterly and annual basis.
Respond to branches and other departments’ e-mails and queries related to Litigation.
Prepare Litigation -related training materials for Legal clinics.

Leadership & People Management Focus

Determine and analyze training and development needs for Litigation unit ensure that identified training is executed.
Act as a second level of escalation point for all grievances raised in the unit, work with subordinates in the team to achieve excellent business results through continuous people development and monitoring activities.
Manage staff and daily operations of the Litigation Unit to ensure all requirements of the bank are met in a timely, efficient, effective, and ethical manner.
Agree on targets and take accountability for the overall achievements of performance objectives within the Litigation Unit and the Legal department in terms of employee satisfaction, customer experience, and cost performance, return on investments, risk, and compliance and governance requirements.

Operations Focus

Prepare quarterly Litigation Reports and Primary Court/Ward Tribunal cases tracker.
Prepare monthly reports on litigation movement, insourced cases, deed of settlement tracker.
Prepare civil litigation unit’s weekly reports for submission to Senior Manager; Civil Litigation
Manage the execution of TRA Agency Notices end-to-end.
Manage the compliance to probate orders for account closure and Garnish orders to ensure mitigation of risks related to delayed or non-compliance.

Qualifications and Experience:

Bachelor’s degree in Law
A Master’s degree in Law (LL.M) will be an added advantage
Must be an Advocate with minimum 7 years on the Bar
A least 5 years’ working experience in a Legal environment, with 3 years in a Managerial position.
Work experience in Commercial Banks is preferred.
